1. Acceptance of These Terms
These Terms of Use govern your access to and use of talospestcontrol.com, including its pages, forms, content, customer portal links, scheduling features, and other website functionality.
The website is operated by Three Amigos Pest Control, Inc., doing business as Talos Pest Control. In these Terms, “Talos Pest Control,” “Talos,” “we,” “us,” and “our” refer to Three Amigos Pest Control, Inc., doing business as Talos Pest Control.
By accessing or using the website, you acknowledge that you have read and agree to these Terms of Use and our Privacy Policy. If you do not agree, you should not use the website.
If you use the website on behalf of a business, homeowners association, property management company, property owner, or another organization, you represent that you have authority to act on its behalf.
2. Website Terms Versus Service Agreements
These Terms govern use of the website. They do not replace any estimate, proposal, inspection report, work authorization, recurring service plan, warranty, payment authorization, or pest control service agreement between you and Talos.
Pest control services are governed by the written agreement applicable to the service. That agreement may contain additional provisions addressing:
- Services and covered pests
- Treatment methods
- Pricing and payment
- Property access
- Customer preparation requirements
- Recurring service
- Cancellation
- AutoPay
- Warranties and guarantees
- Retreatments
- Exclusions and limitations
- Arbitration or dispute resolution, if applicable
If these Terms conflict with a signed service agreement concerning pest control services, the signed service agreement controls with respect to those services.
Submitting a website form, requesting an estimate, or scheduling an inspection does not by itself create a pest control service agreement unless Talos expressly confirms otherwise in writing.
3. Eligibility and Permitted Use
You must be at least 18 years old and legally capable of entering into a binding agreement to submit a service request or enter into a transaction through the website.
You may use the website only for lawful purposes and in accordance with these Terms.
You may not:
- Use the website in violation of any law or regulation
- Submit false, misleading, fraudulent, or unauthorized information
- Impersonate another person or misrepresent your authority
- Attempt to gain unauthorized access to any account, system, server, or network
- Introduce viruses, malicious code, or harmful technology
- Interfere with the operation or security of the website
- Use bots, scrapers, crawlers, or automated systems to extract website content without written permission
- Copy, republish, sell, or commercially exploit website content without authorization
- Use the website to send spam or unauthorized solicitations

- Use Talos trademarks or content in a manner that implies an unauthorized affiliation, sponsorship, or endorsement

4. Estimates, Inspections, and Service Requests
Information submitted through the website is used to evaluate and respond to requests for pest control and related services.
Website descriptions and preliminary estimates are not necessarily final quotations. Pricing, treatment recommendations, availability, and service eligibility may depend on:
- The property’s location, size, design, and condition
- The type and extent of pest activity
- Inspection findings
- Access requirements
- Treatment methods
- Labor and material requirements
- Safety considerations
- Applicable laws and regulations
- The service plan selected
A final price or scope of work may require an inspection and written service agreement.
Submitting a preferred appointment date or time does not guarantee availability. An appointment is confirmed only when Talos provides confirmation.
Service availability varies by location. The website’s accessibility in a particular area does not mean every service is available at every property.
5. Pest Information and Treatment Results
Website content concerning pests, infestations, treatment options, property conditions, health risks, or prevention is provided for general educational purposes.
Online content cannot replace an onsite inspection or property specific recommendation. Pest identification and treatment recommendations may change after inspection.
Pest activity and treatment results may be affected by property conditions, sanitation, moisture, neighboring properties, weather, construction, landscaping, customer preparation, reintroduction, and other circumstances outside Talos’s control.
Any warranty, retreatment obligation, satisfaction commitment, or guarantee applies only when expressly included in the applicable written service agreement or plan. Website language does not create an additional warranty beyond the written agreement.
6. Safety Information
Pesticides, traps, exclusion materials, fumigation procedures, heat treatments, equipment, and other pest control methods may require specific precautions.
Customers must follow all preparation instructions, safety notices, labels, reentry requirements, and technician directions associated with a service.
Website content is not medical, veterinary, environmental, engineering, legal, or emergency advice. Contact an appropriate professional or emergency service if you believe a person, animal, property, or the environment is in immediate danger.
Do not use website content to select, mix, apply, or dispose of pesticides contrary to product labeling or applicable law.
7. Promotions and Special Offers
Promotions are subject to the specific terms displayed with each offer. Restrictions may include:
- Geographic service area
- Participating locations
- New customer status
- Residential or commercial property eligibility
- Qualifying service type
- Minimum purchase or service plan
- Initial service limitations
- Expiration date
- AutoPay or agreement requirements
- Availability
- Prohibition against combining offers
A promotion does not apply unless the property, customer, and requested service satisfy the offer’s stated conditions.
Talos may correct typographical errors or withdraw an offer when permitted by law. We will not retroactively change an offer after a customer has entered into a binding agreement based on that offer.
If advertising language conflicts with the written terms displayed for a specific promotion, the specific offer terms control to the extent permitted by law.
8. Recurring Services and Automatic Renewal
Some Talos service plans may involve recurring service, recurring charges, or automatic renewal.
Any recurring service arrangement will be governed by a separate service agreement that identifies the material terms, including frequency, price, renewal terms, cancellation procedures, and any minimum commitment.
Website Terms alone do not authorize recurring charges.
Where required by law, Talos will present automatic renewal terms clearly, obtain affirmative consent, provide required acknowledgments or reminders, and offer a legally compliant cancellation method.
California imposes specific requirements on automatically renewing consumer agreements. The website and Talos service agreements must be configured to comply with those requirements whenever an automatically renewing plan is offered.
9. Payments
When online payment functionality is available, payments may be processed by an independent payment provider.
You represent that:
- The payment information you provide is accurate
- You are authorized to use the selected payment method
- You authorize the applicable charge
- You will promptly update inaccurate payment information
Additional payment, returned payment, cancellation, or collection terms may appear in the applicable service agreement.
Nothing in these Terms authorizes Talos to impose a fee or charge that was not properly disclosed or permitted by applicable law.
10. Electronic Communications
When you contact Talos electronically, submit a website form, or create an online account, you consent to receive electronic communications relating to that interaction.
These may include:
- Estimate responses
- Appointment confirmations
- Service reminders
- Account notices
- Payment communications
- Customer support responses
- Service related disclosures
You are responsible for providing accurate contact information and maintaining access to the email address or telephone number provided.
Electronic communications satisfy any legal requirement that a communication be in writing to the extent permitted by law.
11. Text Messages and Promotional Communications
If you provide a telephone number, Talos may call or text you regarding your inquiry, appointment, service, account, or transaction.
Promotional calls or text messages will be sent only when Talos has the consent required by applicable law.
When you separately consent to promotional text messages:
- Consent is not a condition of purchasing services
- Message frequency may vary
- Message and data rates may apply
- You may reply STOP to opt out
- You may reply HELP for assistance
Opting out of promotional messages does not prevent necessary communications about an existing appointment, account, transaction, safety concern, or service request when permitted by law.
Additional messaging terms may be provided with the relevant consent request.
12. Customer Portal and Account Security
The website may link to a customer portal operated by Talos or a service provider.
You are responsible for:
- Maintaining the confidentiality of your login information
- Using accurate account information
- Restricting unauthorized access to your account
- Notifying Talos promptly of suspected unauthorized activity
You may not use another customer’s account without permission.
Third party portal technology may also be governed by the provider’s terms and privacy policy. Talos is not responsible for independent services outside its reasonable control, but this does not limit any responsibility that cannot legally be excluded.
13. Intellectual Property
The website and its content, including text, graphics, photographs, videos, designs, page layouts, logos, icons, software, and other materials, are owned by or licensed to Talos and are protected by intellectual property laws.
Talos grants you a limited, revocable, nonexclusive, nontransferable right to access and use the website for personal or legitimate business purposes related to evaluating or obtaining Talos services.
You may print or save a reasonable number of website pages for your own noncommercial use.
Unless Talos gives prior written permission, you may not:
- Reproduce or republish substantial website content
- Modify or create derivative works from website materials
- Remove copyright, trademark, or proprietary notices
- Sell, license, or commercially exploit website materials
- Frame or mirror the website
- Use Talos content to train or develop a commercial artificial intelligence system

14. Trademarks
“Talos Pest Control,” its logos, service names, slogans, and related branding are trademarks or other proprietary identifiers of Three Amigos Pest Control, Inc., or its licensors.
You may not use Talos branding without prior written permission except for lawful, nonmisleading references to the company.
Other names and trademarks appearing on the website belong to their respective owners.
15. Reviews, Photographs, and Submitted Materials
If you voluntarily provide a review, testimonial, photograph, video, or other material for publication, you represent that:
- You created the material or have permission to provide it
- The material is truthful and based on your genuine experience
- The material does not violate another person’s rights
- The material does not contain unlawful, defamatory, or misleading content
Talos may request separate permission before using a customer’s name, likeness, property photographs, testimonial, or other content in advertising.
Talos will not condition compensation or incentives on a customer providing a positive review. Any material connection or incentive associated with a testimonial must be clearly disclosed.

16. Copyright Complaints
If you believe content on the website infringes your copyright, send a written notice to info@talospestcontrol.com containing:
- Your contact information
- Identification of the copyrighted work
- Identification and location of the allegedly infringing material
- A statement that you have a good faith belief the use is unauthorized
- A statement that the information in the notice is accurate
- Your physical or electronic signature
We may request additional information before acting on a notice.
17. Third Party Websites and Services
The website may link to customer portals, payment services, mapping services, social media platforms, review websites, or other third party resources.
Links are provided for convenience and do not necessarily represent endorsement. Talos does not control independently operated third party websites.
Your use of a third party service may be governed by that party’s terms and privacy policy.
18. Website Availability and Changes
We may modify, suspend, restrict, or discontinue any portion of the website. We do not guarantee that the website will always be available, uninterrupted, secure, or error free.
We may update website content, but we do not guarantee that every page will always be current or complete.
Nothing in this section permits Talos to avoid an obligation created by an existing service agreement or applicable law.
19. Website Disclaimer
To the fullest extent permitted by law, the website and its general informational content are provided “as is” and “as available.”
Talos does not warrant that:
- The website will always be uninterrupted or error free
- All website information will be complete or current
- The website will be free from malicious code
- General website content will be suitable for every property or pest condition
This disclaimer applies to the website and its general content. It does not eliminate warranties, duties, guarantees, or remedies that arise under an applicable service agreement or that cannot be excluded under law.
20. Limitation of Liability for Website Use
o the fullest extent permitted by law, Talos and its officers, employees, agents, licensors, and website service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of or inability to use the website.
This limitation does not apply to:
- Pest control services performed by Talos
- Obligations under a written service agreement
- Gross negligence or willful misconduct
- Fraud or intentional misrepresentation
- Personal injury or property damage where liability cannot legally be limited
- Statutory consumer rights or remedies that cannot be waived
- Any other liability that applicable law does not permit Talos to exclude
If Talos is found liable for a claim arising solely from website use, its aggregate liability will not exceed 100 dollars or the amount you paid specifically to use the website, whichever is greater, unless applicable law requires otherwise.
21. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Talos and its officers, employees, and agents from third party claims arising from:
- Your unlawful use of the website
- Your intentional violation of these Terms
- Content you submit without authorization
- Your infringement of another person’s rights
This provision does not require a consumer to indemnify Talos for Talos’s own negligence, misconduct, statutory violations, or failure to perform contracted services.
22. Governing Law and Venue
These Terms and disputes arising solely from use of the website are governed by the laws of the State of California, without regard to conflict of law rules.
Subject to applicable consumer protection law, legal proceedings arising solely from website use may be brought in the state or federal courts serving San Diego County, California.
Nothing in these Terms deprives an Idaho or California consumer of nonwaivable rights, remedies, or venue protections available under applicable law.
A pest control service agreement may contain a different legally valid governing law, venue, or dispute resolution provision based on the property’s location.
23. No Website Arbitration Provision
These website Terms do not independently require arbitration.
If a Talos service agreement includes an arbitration provision, that provision must be presented as part of the applicable agreement and will govern only to the extent it is valid and enforceable.
24. Changes to These Terms
We may update these Terms periodically. Changes become effective when the revised Terms are posted, unless a later effective date is stated.
Changes do not retroactively alter a transaction or service agreement entered into before the revised Terms became effective.
The “Last Updated” date identifies the most recent revision.
25. Severability
If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary. The remaining provisions will continue in effect.
26. No Waiver
Talos’s failure to enforce a provision does not waive its right to enforce that provision later. A waiver is effective only if made in writing by an authorized Talos representative.
27. Entire Agreement Concerning Website Use
These Terms and the Privacy Policy constitute the agreement between you and Talos concerning general use of the website.
They do not replace or modify an estimate, service plan, work authorization, warranty, payment authorization, or signed pest control agreement.
